O foro privilegiado da mulher nas ações relativas ao direito de família e o princípio da isonomia à luz dos instrumentos internacionais de proteção dos direitos humanos

O objetivo deste artigo é oferecer subsídios para a discussão sobre a nova regra especial de foro privilegiado da mulher, que deixa de existir no novo Código de Processo Civil. O paradigma que orientou essa alteração funda-se na igualdade entre homens e mulheres declarada no texto Constitucional de 1988, em especial em seu artigo 226 §5º
na parte relativa ao Direito de Família, que eliminou a hierarquia inserida no Código Civil de 1916. A reflexão desenvolvida neste texto tem por objetivo oferecer subsídios para problematizar essa alteração à luz do direito internacional dos direitos humanos, recepcionado pela Constituição de 1988. Para tanto, destaca a importância da compreensão do princípio da isonomia em seu aspecto formal e material.
Apresenta, como ponto de partida para tal compreensão, uma síntese do panorama dos direitos civis das mulheres no Brasil, destacando o descompasso entre a igualdade formal e igualdade material entre homens e mulheres.

The purpose of this article is to provide subsidies to the discussion on the new special rule on privileged forum to women, which ceases to exist in the new Civil Procedure Code. The paradigm that guided this change is based on the equality between men and women declared in the 1988 Constitutional text, in particular Article 226 §5o relating to family law, which eliminated the hierarchy inserted in the 1916 Civil Code. The reflection developed in this paper aims to provide insight to discuss this change in the light of international human rights law, approved by the 1988 Constitution. It highlights the importance of understanding the principle of equality in its formal and material aspect. Presents, as a starting point for such an understanding, a panorama of the synthesis of the civil rights of women in Brazil, highlighting the gap between formal and material equality between men and women.
